How to deposit the bail of the rent safely
Once your lease contract is signed, you must, normally, pay a bail as an initial proof of your commitment.
In order to make this transaction in the safest way possible, most autonomous communities have put at the disposal of the citizen service offices to deposit the rental of properties. This guarantees the obligation imposed by the new law of urban leases 29/1994. Coming next, we explain you how it works and where that deposit must be done.
Who is required to deposit the bail of the rent on a lease contract?
The obligation to deposit the bail of the rent, is born automatically when housing or local rental contracts are held, if the corresponding autonomous community has established the obligation of deposit. The lessor, either the owner of the house or person authorized by him, has the duty to pay the bail in his autonomous community.
All the autonomous communities have regulated this matter including the obligation of deposit, with the exception of the Comunidad Foral de Navarra, Principado de Asturias and La Rioja, which do not require the deposit of tha bail of the rent in public body. - Cataluña: Instituto Catalán del Suelo (INCASÓL)
- Galicia: Instituto Gallego de Vivienda y Suelo
- Comunidad Valenciana: Registros de la Dirección Territorial o General de la Conselleria de Hacienda de Valencia.
- Canarias: Instituto Canario de la Vivienda.
- Aragón: Instituto del Suelo y la Vivienda de Aragón
- Castilla y León: Cámaras de la Propiedad Urbana de Castilla y León.
- Castilla la Mancha: Dirección General de la Vivienda, Urbanismo y Planificación Territorial.
- País Vasco: BIZILAGUN (Departamento de Vivienda)
- Región de Murcia: Caja de Depósitos de la Comunidad Autónoma de Murcia.
- Extremadura: Caja General de Depósitos de la Dirección General de Vivienda de Extremadura.
- Islas Baleares: Institut Balear de l’Habitatge (IBAVI)
- Cantabria: Dirección General de Tesorería y Presupuestos del Gobierno de Cantabria.
How do I do the deposit of the rent?
- Sign a deposit contract, along with rent, which sets the amounts and conditions for return.
- To formalize it, you must fill out a form provided for this purpose, which will be different depending on the autonomous community. For example, in the case of Andalusia is the model 806 of the tax agency.
- You can pay the bail of the rent by deposit or by transfering the amount into the account that corresponds to.
What will happen when the lease contract is finished?
Once completed the lease contract, the landlord must:
1. request from the autonomus community a refund of the rental deposit, and
2. return it to the tenant, provided that it has not breached the contract.
And if the owner does not want to return me the bail?
If the lessor does not deposit the deposit of the rent within the period of one month, you can be punished with fines and payment of interests. In addition, if for this reason the tenant has suffered some sort of injury, for example, Hacienda not taking him into account deduction for renting, you can incur liability and therefore the tenant may sue you demanding the repair of damages caused by the breach of his contractual obligations, if it proves the damages suffered by that non-compliance.
